Terms and Conditions of UESGo

These general terms of use and legal information (hereinafter, “General Terms”) apply to the website www.ues.com.uy/uesgo and to the UESGo mobile application (collectively referred to as “the Platform”), owned by UES S.A. By accepting these terms during user registration, the User also agrees to the rights, obligations, and responsibilities policies that must be followed when using UESGo services. Failure to comply may result in sanctions. Any person who does not accept these Terms and Conditions (which are binding and mandatory) must refrain from using the Platform and/or its services.

Delivery Request Hours

Delivery requests must be scheduled Monday to Friday from 9:00 AM to 6:00 PM. Deliveries will be completed within a maximum of 3 hours throughout Montevideo.

Access

To become a UESGo App User, the following requirements must be met:

Be at least 18 years of age.

Accurately complete the mandatory fields in the registration form (username, email, phone number, etc.).

Accept these Terms and Conditions of Use and Contracting.

Accept the Privacy and Data Protection Policy.

The User guarantees that the information provided is true, accurate, and complete, and agrees to keep it updated. If any false or incomplete information is provided, or UESGo suspects it, access may be denied or revoked. Account access is personal and non-transferable. UESGo is not responsible for any misuse of the account or application by the User or third parties. The User is solely responsible for safeguarding their login credentials.

Purpose

UESGo is a logistics platform developed by UES S.A. to allow individuals and companies to request courier and messenger services within Montevideo. The Platform enables:

(i) cost calculation,
(ii) product delivery,
(iii) real-time tracking,
(iv) customer support and claims processing.

The term "shipment" includes letters and packages.

Delivery Service Requirements

- Must be point-to-point (single pickup and delivery address).

- Must be within Montevideo.

- Must be within the platform’s operational hours.

- Must include pickup and delivery address, recipient details, and payment method.

- Package must not exceed 30cm x 20cm x 20cm or 5 kg.

- Deliveries will be completed within approximately 3 hours.

- All packages will be photographed at pickup, and proof of delivery will be digitally signed in the app.

Restricted Items Policy

The following are strictly prohibited:

- Food of any kind.
- Regulated animals, fluids, prohibited seeds, endangered species or derivatives.
- Child pornography or content involving minors.
- Unauthorized copies of software/media.
- Counterfeit goods, unauthorized merchandise, fake autographs, etc.
- Devices that bypass digital protections (e.g., modchips).
- Controlled substances, drugs, or paraphernalia.
- Gambling materials (lottery tickets, betting memberships).
- Hacking/cracking tools or guides.
- Human body parts, fluids, embryos, stem cells.
- Stolen or illegally acquired goods.
- Unauthorized telecom devices.
- Culturally protected artifacts.
- Explosives, hazardous materials (e.g., propane).
- Weapons or related items (firearms, knives, silencers).

Liability for Content

UESGo is not obligated to monitor User activity on the Platform and does not verify the identity or data accuracy of Users. UESGo does not inspect the contents of deliveries. Users agree that UESGo is not responsible for transporting items that are prohibited or require special permits. In such cases, UESGo may investigate and take legal or disciplinary actions, including blocking accounts and reporting to authorities.

All shipments must be securely packaged to ensure safe handling and prevent spills.

Service Fees and Billing

Registration and use of the Platform are free. Charges only apply when a delivery service is requested. Prices include applicable taxes and will be confirmed before finalizing the order. UESGo reserves the right to change prices without notice, but changes apply only to new transactions. Invoices will be emailed to the address provided and paid via Mercado Pago.

Claims

To submit a claim regarding a delivery, the User must contact Customer Service via email at uesgo@ues.com.uy.

Incorrect Delivery Address

If an incorrect delivery address is provided, the package will be returned to UESGo’s warehouse. Users will be notified via email and may:

- Request a new delivery,
- Collect the package in person, or
- Authorize the recipient to collect it.

Pickup location: Enrique García Peña 2756, corner of Alejandro Fiol de Pereda, Monday–Friday 9:00–19:00, Saturday 9:00–13:00.

Packages not collected within 30 days will be considered abandoned.

Responsibility for Shipment Contents

In case of loss or damage:

- Declared contents: reimbursement up to $2,000 UYU (less admin fees).
- Undeclared contents: reimbursement up to $500 UYU.

Claims must be submitted within 10 calendar days via email, with valid ID and proof of service. Reimbursement will be processed within 48 business hours after verification.

Intellectual Property

UESGo owns or holds licenses for all intellectual and industrial property rights on the Platform and its content. All rights are reserved, including reproduction, distribution, and transformation rights.

Severability

If any clause is found invalid or unenforceable, the rest of the agreement remains in full effect.

Applicable Law

These Terms are governed by Uruguayan law. Any dispute shall be resolved by the courts of Montevideo.

PRIVACY POLICY

By using the UESGo App, Users entrust us with their personal information. This Privacy Policy explains how we collect, process, and protect that information.

This Policy does not apply to external websites linked from our app or site.

By accepting this Policy, you authorize UESGo to process your data in accordance with Uruguay’s data protection law (Law No. 18.331).

Users are responsible for ensuring the accuracy and currency of the data provided.

UESGo respects and upholds the following principles:

- **Legality:** Data will be processed in compliance with applicable laws.
- **Freedom:** Personal data will be collected with informed and express consent.
- **Purpose:** Data will be used only for legitimate purposes.
